TERMS:

All purchases on StyleFlip.com will be governed by the following terms:

NOTE: No copyrighted material, nudity, violence, drugs, or otherwise explicit content will be accepted for print.

These terms ("Terms") apply to all uses you ("You") may make of this website (the "Site") including, but not limited to any: use of the Site's product customization and ordering service ("Service") and skin products ("Skins" or "Products").

1. YOUR SUBMISSIONS TO THE SITE:

1.1 Under these Terms, You may NOT place any of the following material or obtain any such material using the Service (a "Submission"):

* Any threatening, obscene, pornographic, or profane material or any material giving rise to civil or criminal liability.
* Any material infringing privacy, publicity, trademark, or copyright rights without proper authorization.
* Any material submitted from a false, misleading, or anonymous source.

1.2 While StyleFlip ("Seller") is not responsible for the content of Submissions, Seller reserves the right to review, edit, refuse, suspend, or cancel any order involving content deemed unacceptable, infringing, abusive, or unlawful. Seller may request proof of ownership or rights. Orders may be suspended or canceled without refund if authorization is not provided.

You warrant that all moral rights in submitted materials are waived and that You possess full rights to grant usage. Seller shall not be liable for Submission content.

1.3 Copyright Notice. You must own or have permission to use any uploaded content. Infringement notices may be submitted to [email protected].

1.4 Unauthorized Use. If infringement is discovered, Seller may halt production, cancel the order, and issue no refund.

2. CUSTOMER SUPPORT AND AGE REQUIREMENTS:

You must be at least 13 years of age to use the Site. Users under 18 confirm they have parental or guardian permission.

3. CUSTOM PRODUCTS, DESIGN & MANUFACTURING:

All Products are custom-made based on customer inputs. Once production begins, orders cannot be modified or canceled.

Color variation may occur due to screen differences and materials. A manufacturing tolerance of ±2mm is acceptable.

Any design assistance provided does not transfer responsibility. Final approval rests with the customer.

4. MARKETING, PROMOTIONAL & PUBLICITY RIGHTS:

By submitting, uploading, approving, or otherwise providing any design, image, text, review, testimonial, logo, or content, You grant Seller a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, modify, publish, display, distribute, and promote such content for marketing, advertising, promotional, portfolio, website, social media, and commercial purposes, in any media now known or later developed.

This license includes use of associated names, usernames, brand names, business names, likenesses, and identifiers as provided or made publicly available by You, without additional approval or compensation.

No compensation, royalties, or attribution are owed for such use. Seller has no obligation to remove promotional use once published.

You represent and warrant that You have all rights necessary to grant this license and agree to indemnify Seller for any related claims.

5. SHIPPING, DELIVERY & INTERNATIONAL ORDERS:

Shipping fees are non-refundable. Seller is not responsible for delays caused by carriers, customs, or incorrect addresses.

International delivery issues may require up to 30 business days to investigate.

Risk of loss passes to You upon delivery to the carrier (F.O.B. Seller facility).

6. RETURNS & REFUNDS:

Returns are accepted within 30 days of delivery. Custom items are subject to inspection. Shipping costs are non-refundable.

7. ACCOUNT USE, FRAUD & TERMINATION:

You are responsible for safeguarding account credentials.

Seller may cancel orders, withhold refunds, recover fees, or terminate accounts for fraud, abuse, excessive chargebacks, or violations.

8. PRIVACY POLICY & INTERNATIONAL DATA:

Personal data is handled per our Privacy Policy. The Site is operated from the United States. If You access the Site from outside the U.S., You consent to the transfer, storage, and processing of Your information in the United States and other jurisdictions where Seller or its service providers operate.

For users in the European Economic Area (EEA), Seller processes personal data in accordance with applicable data protection laws, including the GDPR, as further described in the Privacy Policy.

9. THIRD-PARTY SERVICES:

The Site integrates third-party platforms including Shopify, Meta (Facebook/Instagram), Google services, payment processors, and shipping carriers. Seller is not responsible for third-party outages or actions.

10. DISCLAIMER OF WARRANTIES:

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

11. LIMITATION OF LIABILITY:

TO THE FULLEST EXTENT PERMITTED BY LAW, SELLER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.

12. FORCE MAJEURE:

Seller is not liable for delays or failures caused by events beyond reasonable control, including weather, labor disputes, supply shortages, pandemics, governmental actions, or internet outages.

13. SERVICE INTERRUPTIONS:

Seller does not guarantee uninterrupted access to the Site and is not liable for downtime or service disruptions.

14. PRICING & CURRENCY:

All prices are listed in U.S. Dollars (USD). Pricing errors may result in cancellation or correction.

15. ELECTRONIC COMMUNICATIONS:

You consent to receive communications electronically and agree electronic records and signatures are legally binding.

16. DISPUTE RESOLUTION, ARBITRATION & CLASS ACTION WAIVER:

Before initiating arbitration or litigation, the parties agree to attempt to resolve any dispute through good-faith negotiations for a period of 30 days after written notice of the dispute.

If the dispute is not resolved through negotiation, it shall be resolved by binding arbitration conducted in the State of Minnesota, unless Seller elects to pursue the matter in court.

You agree that any dispute resolution proceedings will be conducted on an individual basis only and not as part of a class, collective, or representative action.
